Terms and Conditions

  1. By booking through Lihim Resorts, Inc. website and online booking services, including those offered through third-party online travel agencies (OTAs), you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before making a reservation.

    1. Acceptance of Terms

    By using our website or booking services, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you do not agree to these terms, please do not use our services.

    2. Reservation Policies

    2.1 Booking Confirmation

        • All reservations are subject to availability and will be confirmed via email. Please ensure that the email address provided is accurate and regularly checked.

    2.2 Payment

        • A valid credit card is required to secure your booking. Payment terms and conditions will be specified at the time of booking, including any required deposits or prepayments.
        • For reservations made through OTAs, their specific payment terms will apply.

    2.3 Deposit Policy

        • For bookings with a stay of 1 night, 100% of the total stay is required to reserve a room.
        • For bookings with a stay of more than 1 night, 50% of the total stay is required to reserve a room. The remaining balance should be settled upon arrival.

    2.4 Cancellation, No-Show, and Modification Policy

        • Kindly refer to the Cancellation and Modification Policy detailed separately. In the event of No Show or Early Departure, the reservation will be subject to a cancellation equivalent to full room night charge.
        • Any changes to your reservation are subject to availability and may incur additional charges. Please contact us directly for modifications.

    3. Check-In and Check-Out

    3.1 Check-In

        • Standard check-in time is from 2:00 PM onwards. Early check-in requests are subject to availability and may incur additional charges.
        • Express check-in will be implemented wherein necessary forms and incidental deposit should be provided prior to arrival.
        • An incidental deposit equivalent to one (1) room night is required prior to arrival, which would be refunded upon check-out should no charges occur.

    3.2 Check-Out

        • Standard check-out time is 12:00 PM. Late check-out requests are subject to availability and may incur additional charges.

    3.3 Identification

        • A valid government-issued ID and the credit card used for booking must be presented upon check-in.

    4. Use of Facilities

    4.1 General Rules

        • Guests are expected to respect and adhere to the rules and regulations of Lihim Resorts, Inc. Any damage to property or violation of rules may result in additional charges and/or termination of the stay.

    4.2 Pool and Recreational Areas

        • Use of pool and recreational areas is at your own risk. Children must be supervised by an adult at all times.

    4.3 No Smoking Policy

        • Lihim Resorts is strictly implementing a No Smoking Policy in rooms. Designated smoking areas are available for guests.

    4.4 Environmental Commitment

        • As part of our commitment to environmental sustainability and to maintain the cleanliness of the area, we are requesting your participation in the NO SINGLE-USE PLASTIC Policy of El Nido, Palawan.

    5. Local Regulations

    5.1 Attire

        • Wearing of swimming attire outside the beach area is highly discouraged. Kindly wear modest clothing, such as shirts, shorts, dresses, or other attire that fully covers the torso, when in public places.

    5.2 Smoking Restrictions

        • Smoking of tobacco, e-cigarettes, and the like in public areas such as streets, buildings, beach fronts, and outdoor spaces is prohibited except in designated areas where cigarette waste and butts can be properly disposed.

    6. Travel Insurance

    Lihim Resorts, Inc. recommends that all guests have independent travel insurance while traveling. We strongly recommend that ALL clients take out personal travel insurance at the time of booking against illness, injury, death, loss of luggage, personal items, medical cancellations, and extreme weather evacuations/displacements.

    7. Limitation of Liability

    Lihim Resorts, Inc., its affiliates, and staff shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our website, booking services, or stay at our property. This includes, but is not limited to, damages for loss of profits, data, or other intangibles. Lihim Resorts, Inc. does not accept responsibility for delays, additional expenses, or inconveniences which may be caused by events beyond our control such as travel agent error, late arrival of air flights, civil and political disturbance, fire, acts of God, national emergencies, strikes, or causes beyond reasonable control of the Resort.

    8. Force Majeure

    We shall not be held liable for any failure or delay in performing our obligations due to circumstances beyond our control, including but not limited to natural disasters, acts of God, war, terrorism, and government actions.

    9. Governing Law and Dispute Resolution

    These Terms and Conditions are governed by the laws of the Republic of the Philippines. Any disputes arising from or related to these terms shall be resolved through amicable negotiation. If a resolution cannot be reached, the dispute shall be submitted to the exclusive jurisdiction of the courts of the Republic of the Philippines.

    10. Amendments

    We reserve the right to amend these Terms and Conditions at any time without prior notice. The latest version will be posted on our website, and continued use of our services constitutes acceptance of the updated terms.

Cancellation and Modification Policy

At Lihim Resorts, Inc., we understand that plans can change. Our cancellation and modification policy is designed to be fair and straightforward. Please review the details below to understand our terms:

 

1. General Policy

  • All cancellations and modifications must be requested in writing via email to reservations@lihim.com or by calling +639173188998.
  • The date of receipt of the cancellation/modification request will be considered the effective date of the cancellation/modification.

2. Cancellation Policy

2.1 Cancellations Made More Than 30 Days Prior to Arrival

  • If a reservation is cancelled more than 30 days prior to the scheduled arrival date, no penalty charge will apply, and any deposit paid will be fully refunded.

2.2 Cancellations Made Within 30 Days or Less Prior to Arrival

  • If a reservation is cancelled within 30 days or less prior to the scheduled arrival date, the deposit paid is non-refundable.
  • In the event of a no-show or early departure, the reservation will be subject to full room night charge for the entire reserved stay.

3. Modification Policy

3.1 Modifications Made More Than 30 Days Prior to Arrival

  • If a reservation is modified more than 30 days prior to the scheduled arrival date, no penalty charge will apply, and the modification will be subject to availability. Any difference in room rates or additional charges due to the modification must be settled accordingly.

3.2 Modifications Made Within 30 Days or Less Prior to Arrival

  • If a reservation is modified within 30 days or less prior to the scheduled arrival date, the modification will be subject to availability and may incur additional charges.
  • Any reduction in the length of stay or changes in room type within 30 days or less prior to arrival may result in penalty charges up to the amount of the original reservation.

4. Special Circumstances

  • In the case of extraordinary circumstances such as natural disasters, medical emergencies, or other unforeseen events, we will review cancellation and modification requests on a case-by-case basis. Documentation may be required to support such requests.

5. Refund Processing

  • For credit cards, the refund will be credited back within 14 to 30 business days, depending on the issuing bank. Refunds will be credited to the original payment method used for the reservation.
  • Lihim Resorts, Inc. is not responsible for any differences in the refunded amount due to currency exchange rate fluctuations or additional fees charged by banks or payment processors.

6. Third-Party Bookings

  • For reservations made through third-party online travel agencies (OTAs), the cancellation and modification policies of the respective platform will apply. Please refer to the specific terms and conditions provided by the OTA at the time of booking.
